CBD or CBD oil refers to cannabidiol. It is an organic substance that can be obtained from the Cannabis Sativa plant. 

Though CBD seems like a drug that makes you euphoric as it comes from the same plant as marijuana, it is not the case. CBD is very effective in treating various medical conditions like anxiety, pain, arthritis, Alzheimer’s, and several others. 

Unlike Marijuana, CBD cannot be smoked. Instead, it is taken in the form of edibles or tinctures. 

What is CBD?

The cannabis plant has two most essential components, these are marijuana and hemp. Cannabidiol oil (CBD) can be extracted both from marijuana and hemp. However, the amount of tetrahydrocannabinol (THC) varies in both marijuana and hemp. The THC concentration extracted from Marijuana is more than 0.3% THC, while in hemp; it is less than 0.3%. 

With passing years many studies and evidence have supported the benefits of CBD in medical applications. It is found beneficial in relieving pain and useful against high blood pressure and muscle tension. 

CBD oil can be used as an effective anti-inflammatory drug. It also acts as an anticonvulsant for people going through seizures. Also, it is really beneficial in treating anxiety, Epilepsy, Alzheimer’s, and ADHD. 

Though much evidence supports the use of cannabidiol, its medical benefits are not approved by the Food and Drug Administration. But in the 2018 farm bill, cannabidiol obtained from hemp containing a very low amount of THC that is 0.3% has been legalized. However, the FDA has still preserved authority over hemp products. 

Medical use of Cannabis has been allowed to several medical companies that are federally licensed. Nevertheless, the FDA has issued warning letters to several food companies that claim to treat serious diseases. Based on some clinical studies, the FDA has found that many safety risks are concerned with CBD and that it is not a risk-free substance. 

The federal government of the US has legalized the use of CBD in a controlled amount, but many state authorities are still considering its benefits and safety risks. 

The legality of CBD Worldwide

CBD is not legal in all the countries of the world. Some countries have made it legal, but with lots of regulations. Only certain companies have the license to grow, sell and purchase CBD oil in every country. 

Every country has its own laws regarding the legality of CBD. 

CBD in Europe 

Laws in Europe are different when it comes to the legality of Cannabis. However, the general law of the EU has made the consumption of CBD legal, having no more than 0.2% THC. Crimes related to Cannabis vary from country to country in Europe. Therefore, laws are also different in each country.  

France

This is the largest hemp-producing country in Europe. The laws in France regarding Cannabis are not very clear. For commercial needs, 0.2% THC is the allowed limit. However, for sales and consumption, 0% THC is the legal amount.

Germany

CBD is completely legal in Germany, while Cannabis is illegal. In order to intake CBD in the form of medicine, a patient should have a marijuana card and prescription from a doctor. 

Russia

Although the cultivation of Cannabis is legal in Russia, it is illegal to extract, sell, or use cannabis in any form in this country. 

Norway

CBD is legal in Norway, but with the condition of 0% THC. If prescribed by a doctor, people can use CBD legally. 

Sweden 

CBD is still considered a drug in Sweden. It has not been given the status of medicine by the law. The general EU law is followed by Sweden. According to that, 0.2% THC is considered legal. 

Greece

The same EU law is followed in Greece. Products obtained from hemp in Greece are not considered drugs. This is because the amount of THC is low in hemp. CBD containing 0.2% or less THC is legal in Greece. 

Finland

Cannabis is illegal with harsh punishment even for minor possession in Finland. CBD is legal in Finland as it is considered a medicine. Patients can use it under a license or a prescription from a doctor. 

CBD in other Countries of the World

Japan

Cannabis is completely banned in Japan, and the law holds severe punishment if someone is accused of its possession. However, CBD is categorized as a medicine; therefore, it is legal in Japan as long as the level of THC is at 0%.

Canada

CBD is legal in Canada as long as it is being used for medicinal purposes. CBD oil with 0.3% THC or less is legal in Canada. 

CBD in the Middle East and Asia 

The Middle Eastern and Asian countries have very strict laws regarding Cannabis. The majority of the countries in Asia have banned CBD. In countries like Saudi Arabia, the punishment is as strict as execution for possessing any cannabis-related product. 

Australia 

Australian people need to gain approval from the Department of Health to use CBD oil as a medicine. 

New Zealand 

Patients in New Zealand have to take a prescription from a medical professional to use CBD oil. 

CBD in the US

In the US, according to the law passed by the FDA government, if a product contains 0.3% THC, it is considered illegal. However, all 50 states of the United States have different laws regarding CBD legality. 

Alabama

In Alabama and several other US states like Georgia, Indiana, South and North Carolina, and other Amber-Red states, Cannabis is completely illegal. However, CBD oil is legal if it contains 0.3% THC or less. 

California

People can freely buy medicinal Cannabis in California and some other states like Washington, Colorado, Michigan, Oregon, Vermont, Maine, and Alaska. 

New York

CBD oil is legal in New York. However, people need to get a prescription from a medical expert to use CBD. The law is the same for CBD in other states of the US like New Hampshire, New Jersey, Hawaii, Florida, Pennsylvania, Utah, and several other Amber states. 

The states where CBD is illegal include Nebraska, Idaho, South Dakota, and Iowa. 

In Conclusion 

CBD is becoming legal due to its health benefits. The governments of many countries are considering its uses in various fields where CBD is illegal. The legality status of CBD is different in different countries. Even different provinces in the same country hold different laws for the legality of CBD oil.
